Kennedy and Cruz File Amicus Brief to Restore Trump to Colorado Ballot

Sens. John Kennedy (R-La.) and Ted Cruz (R-Texas) have filed an amicus brief with the U.S. Supreme Court in the case of Donald J. Trump v. Norma Anderson, seeking to restore former President Trump to the ballot in Colorado. The amicus brief argues that the Colorado Supreme Court's decision to remove Trump from the ballot is a violation of the Constitution and an attempt to disenfranchise voters.

Kennedy criticizes the Colorado Supreme Court's ruling, stating, "Colorado's Supreme Court has mis-stepped and overstepped. Its ruling reeks of politics and bad faith. Colorado's court misinterprets the Fourteenth Amendment in an attempt to seize agency from voters." He calls on the U.S. Supreme Court to protect the Constitution and correct Colorado's move to disenfranchise voters who support Trump.

Cruz also condemns the decision, accusing the radical left of undermining democracy. He says, "While President Biden and his allies claim they are defending democracy, their supporters are working to undermine democracy by banning Biden's likely general election opponent from appearing on the ballot." Cruz expresses confidence that the Supreme Court will see through these actions and emphasizes the importance of defending the Constitution's separation of powers.

Rep. Steve Scalise (R-La.) joins Kennedy and Cruz in filing the amicus brief. He criticizes President Biden and his allies for attempting to undermine the democratic process. Scalise argues that the Colorado Supreme Court has no authority to remove Trump from the ballot and warns of the dangerous precedent it sets. He urges the Supreme Court to consider their arguments and reverse the decision.

The amicus brief highlights several legal errors in the Colorado Supreme Court's ruling. It points out the court's failure to respect Congress's authority to implement Section 3 of the Fourteenth Amendment and highlights that the plain language of Section 3 does not apply to the president.
